Diocese Receives $155,000 in Costs

On Friday, July 29th, the Diocese of New Westminster received a cheque in the amount of $155,000.00 from the legal representatives of the 22 individuals, clergy and lay (Plaintiffs) who brought suit against the diocese and Bishop Michael Ingham over control of the assets of four parishes in 2009.

In total, the Plaintiffs brought three proceedings against the diocese, first in the BC Supreme Court, then in the BC Court of Appeal, and finally in the Supreme Court of Canada.

Supreme Court of Canada Dismisses Leave to Appeal
Thursday, June 16, 2011 the Supreme Court of Canada released its Decision refusing Leave to Appeal from the November, 2010 decision of the BC Court of Appeal. At that time, the Court of Appeal upheld the Trial judgment which found that the four parish properties under dispute are to be held in trust by the Diocese of New Westminster for those who wish to worship in the Anglican Church of Canada. We are thankful that the litigation launched against the Diocese of New Westminster is now at an end.

Diocese Opposes Supreme Court Appeal - February 11th, 2011
 VANCOUVER, February 11 – The Diocese of New Westminster today asked the Supreme Court of Canada to bring an end to a lawsuit brought by the Anglican Network in Canada (ANiC) that has dragged on since September of 2008.

In a Brief filed with the Court today, it is asking that the court decline to hear the Appeal initiated by ANiC so the Anglican Church in the Vancouver area can stop spending money on lawyers and devote more resources to ministry for its people and those in need.

Diocese Seeks Cost of Successful Appeal
On Wednesday, February 23rd, 2011, legal counsel for the Diocese of New Westminster filed a Brief in the BC Court of Appeal to seek recovery of court costs incurred in the recent legal proceedings in which, as the Brief affirms, “the Respondents (diocese) were substantially successful both at trial and on appeal and there is no valid basis to depart from the usual rule that they are entitled to their costs.” Read More ...
Appeal and Trial Costs Awarded to the Diocese of New Westminster
On May 19th, 2011, the BC Court of Appeal issued its decision on the matter of trial and appeal costs for the ongoing litigation between four dissident congregations and the Diocese of New Westminster over ownership of church assets.
In a BC Supreme Court decision November 25th, 2009 Justice Stephen Kelleher determined that the property and assets in the four parishes occupied by the dissident congregations were held in trust for people who wish to worship in the Anglican Church of Canada, Diocese of New Westminster, under the jurisdiction of the Bishop of New Westminster. Read More ...
